This North Carolina Divorce Settlement Agreement (hereinafter referred to as "Agreement") is entered into by and between _____________ (hereinafter "Party One") and _____________ (hereinafter "Party Two"), collectively referred to as the "Parties," currently residing in the State of North Carolina, on this ___ day of _________, 20__.
WHEREAS, the Parties were lawfully married on the ___ day of _________, 20__, in ___________, North Carolina; and
WHEREAS, the Parties wish to terminate their marriage by obtaining a divorce, and in conjunction with such divorce, wish to resolve all issues related to their marriage, including but not limited to, asset division, debt division, spousal support, child custody, visitation, and support, without the necessity of court intervention; and
WHEREAS, the Parties have negotiated in good faith and have voluntarily and without duress or undue influence upon the other, arrived at an equitable settlement of their rights and obligations.
NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, and other good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the Parties hereto agree as follows:
1. Marital Assets and Liabilities
